1. Introduction & Acceptance

These Terms & Conditions (“Agreement”) govern your use of the online coaching services provided by Never Give Up Global Fitness, LLC (“Company”, “we”, “us”, “our”).
By enrolling, submitting payment, or otherwise using our services, you agree to these Terms in full.
If you do not agree, please discontinue use of our services.

 

2. Services Provided

The Company provides:

• Customized fitness and nutrition programs.

• One-on-one online coaching and accountability check-ins.

• Optional messaging support and performance tracking.

All programs are designed individually based on your goals, health history, and dietary preferences.

 

3. Client Responsibilities

You certify that:

• You are 18 years of age or older, or have written consent from a parent or legal guardian.

• You will provide accurate, complete, and truthful health, medical, and nutrition information.

• You will promptly inform your coach of any health changes, injuries, or medical conditions.

• You will not modify the provided plans without prior consultation or approval.

Participation in all programs is voluntary and at your own risk.

 

4. Payment & Billing

• All fees are due upon purchase or at the start of your subscription.

• Recurring memberships are billed automatically unless canceled in writing before the next billing date.

• Cancellations become effective at the end of the current billing cycle and are not prorated.

• Prices, durations, and included services are clearly outlined in your selected package.

 

5. Cancellation Policy

• You may cancel your subscription or package at any time with written notice before your next billing cycle.

• No cancellation fees or penalties apply.

• No refunds are offered for partially used services or remaining time after cancellation, unless otherwise stated in a written agreement.

 

6. Refund Policy

• All sales are final once plans are delivered.

• Refunds are only issued in the rare event that the Company fails to deliver the agreed-upon services.

• Each request for a refund will be reviewed on a case-by-case basis.

 

7. Limitation of Liability​

Our services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult with your physician before starting any fitness or nutrition program. Participation in fitness or nutrition programs carries inherent risks. You assume full responsibility for your health and safety.
The Company and its representatives are not liable for any injury, illness, or loss arising from participation, except in cases of gross negligence or willful misconduct.
In all cases, our total liability shall not exceed the total fees paid by you in the previous six (6) months.

8. Confidentiality & Privacy

We take your privacy seriously. All personal and health information provided to us is treated as confidential.
We do not share your personal data with third parties except where required by law or with your explicit consent.

If you are located in the European Union (EU), your information is handled in accordance with the General Data Protection Regulation (GDPR).
You have the right to access, correct, or delete your personal data at any time.

9. Intellectual Property

All materials (training plans, nutrition guides, PDFs, videos, and other resources) are the exclusive property of Never Give Up Global Fitness, LLC.
They are provided for your personal, non-commercial use only.
Reselling, redistributing, or public posting of any content is strictly prohibited without written permission.

 

10. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the appropriate jurisdiction.
Any disputes arising from or related to this Agreement will be resolved in the courts of the appropriate jurisdiction, unless both parties mutually agree otherwise in writing.

 

11. Amendments & Communication

The Company may update or modify these Terms at any time.
Changes will be posted on our website and will take effect 30 days after publication.
Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
